The estate of Jeffrey Epstein is invoking attorney-client privilege to withhold 277 emails exchanged with Kathryn Ruemmler. Court filings indicate these communications involved legal matters concerning lawsuits filed by women who accused Epstein of sexual abuse. The estate argues that it is not required to disclose these emails in ongoing litigation.

Kathryn Ruemmler, Goldman Sachs' chief legal officer, has been under scrutiny following the release of emails showing a closer connection between her and Epstein than previously known. These newly withheld emails are separate from those previously made public, highlighting additional interactions protected by attorney-client confidentiality.

According to a recently published court filing, many of the emails contain legal advice provided to Epstein regarding civil suits by his accusers. The 500-page privilege log lists these communications, noting Ruemmler's role in offering legal guidance. At the time, Ruemmler was co-chair of Latham & Watkins' white-collar defense and investigations practice, though the firm stated Epstein was not a client. Ruemmler has not publicly clarified whether she represented Epstein personally, though she has expressed regret over her association with him. Goldman Sachs described her interactions with Epstein as professional.

Legal Dispute Over Disclosure

The emails in question span from October 2014 to June 2019, shortly before Epsteins arrest on federal sex-trafficking charges. These are distinct from the emails previously released in November through a congressional subpoena, which detailed Ruemmler seeking career advice and networking through Epstein, as well as commentary on political matters.

Before joining Goldman Sachs, Ruemmler was a prominent lawyer in Democratic circles, serving as White House counsel under President Barack Obama and considered for high-profile positions including Supreme Court justice or U.S. attorney general. Several emails involved other attorneys Epstein personally retained, including Darren Indyke, Alan Dershowitz, Ken Starr, Martin Weinberg, and Roy Black. Some of Ruemmlers emails in the public batch were partially redacted for privilege.

Background on Epstein

Epstein, a financier with ties to prominent figures such as Leon Black, Jes Staley, Prince Andrew, Donald Trump, and Bill Clinton, died by suicide in 2019 while awaiting trial on sex-trafficking charges. He had previously pleaded guilty in 2008 to soliciting an underage girl for prostitution in a controversial deal with Florida prosecutors.

Estate Executives and Litigation

The privilege log is part of a lawsuit filed by Epstein's accusers against his estate executors, Darren Indyke and Richard Kahn, alleging they enabled Epsteins sex-trafficking operation. The executors deny wrongdoing. Their attorney, Daniel Weiner, called the claims "categorically false," stating his clients had no knowledge of Epstein's abuse while providing professional services.

The court filing, initially sealed and later released with redactions to protect victim identities, summarizes the emails without revealing full content. Attorneys representing Epsteins accusers argue that the estate is overreaching by asserting privilege and withholding crucial information about Epsteins activities. Some of the emails discuss defense strategies against lawsuits, challenges to his Florida plea deal, and Virginia Giuffres long-running suit against Ghislaine Maxwell.

Notably, Ruemmler was listed as a backup executor in a 2019 draft of Epsteins will but was replaced in the final version by Boris Nikolic. Indyke and Kahn became co-executors. The privilege log describes Ruemmlers involvement in legal matters related to civil and criminal claims, but not estate planning. One April 2019 email is noted as Attorney client communication regarding strategy of defense of legal claims against Jeffrey Epstein. Another from October 2014 is described as providing information at Epsteins legal request about sexual assault allegations.
