A federal judge has temporarily blocked Alabamas recently enacted vaping restrictions after a local retailer and a nationwide advocacy group filed a lawsuit against state officials, according to reports from AL.com.

The legislation, known as House Bill 8, was passed during the 2025 session. It limits retail sales to only 34 vaping products that have received FDA approval, and strictly allows tobacco or menthol flavors. The law was scheduled to take effect on October 1 but is now suspended pending the outcome of the legal challenge.

Joe Ferrell, owner of Southside Vapes with multiple locations across Alabama, has already closed his Fairhope store. He stated that continuing operations under the new restrictions at his other stores would be impossible. Currently, his shops offer about 80 different vaping brands, a variety that would drastically decrease if the legislation is enforced.

The lawsuit argues that Alabamas restricted product list violates federal law, which grants the FDA exclusive authority over vaping product regulation. Southside Vapes and the Vapor Technology Association have filed the case against the Alabama Alcoholic Beverage Control Board and state officials.

While vaping can serve as a smoking cessation aid for adults, health risks remain significant. Vaping aerosols contain addictive nicotine, carcinogens, and toxic metals such as lead, according to the Centers for Disease Control and Prevention. Though some smokers may benefit if vaping replaces traditional cigarettes entirely, long-term health effects are still unclear. Adolescents are particularly vulnerable, as their developing brains are more susceptible to nicotine addiction, and youth face more severe health consequences from vaping.

Environmental concerns are also mounting. Disposable vaping devices contribute to growing landfill waste, containing plastic components and lithium batteries that pose fire hazards if improperly discarded. The trend toward single-use devices has intensified these environmental challenges.

Tony Abboud, executive director of the Vapor Technology Association, emphasized the importance of adult access to vaping products, noting that they play a role in reducing deaths from cigarette-related diseases in the U.S., which number nearly 500,000 annually.

Meanwhile, youth vaping rates have dropped to their lowest point in a decade, according to the CDCs National Youth Tobacco Survey.
