Blake Livelys attorneys filed a motion Thursday requesting the court to reject Justin Baldonis effort to dismiss her lawsuit against him and Wayfarer Studios, insisting that the matter should move forward to trial.

In November, Baldonis legal team asked the court to throw out Livelys claims of sexual harassment and retaliation, describing her accusations as a collection of minor grievances that allegedly did not establish an objectively hostile work environment during the filming of It Ends With Us. This came five months after Judge Lewis J. Liman dismissed Baldonis defamation lawsuit against Lively in June. Baldoni missed the deadline to file an amended complaint, resulting in the full dismissal of his case.

Livelys lawyers argue that Baldoni is trying to evade responsibility by attempting to have her case dismissed as well. According to their motion, In their latest effort to avoid accountability for the hostile environment they created during the production and marketing of It Ends With Us, Justin Baldoni, Wayfarer Studios CEO Jamey Heath, co-founder Steve Sarowitz, and their co-defendants request the Court to prevent the trial, denying Blake Lively her day in court, by attacking every aspect of her sexual harassment and retaliation claims.

The legal filing asserts that Livelys allegations of harassment, toxic workplace conditions, and a coordinated smear campaign are supported by extensive evidence, including documents and witness testimonies. The 72-page motion emphasizes, This is not a case of minor annoyances stemming from creative disagreements, but a demonstration of a hostile environment. Defendants failed to follow Wayfarers policies and ignored complaints instead of addressing them.

Livelys attorneys claim that when complaints were raised on set, Baldoni and his colleagues did not conduct a proper investigation. Instead, they allegedly counterattacked, portraying themselves as victims and accusing Lively of fabricating claims to take control of the production. The defendants legal strategy has repeatedly inverted victim and offender roles, systematically attacking Livelys reputation, the motion notes.

The motion further states, Efforts to depict Livelya seasoned actress and mother of fouras a bully who dominated the films production do not justify harassment, retaliation, defamation, or any other claims brought forward by Lively.

Livelys team maintains that Baldoni and Wayfarers executives leveraged their authority on set to establish a one-sided, toxic atmosphere. While Lively was a star, Heath and Baldoni held full control over her work schedule, salary, and daily activities on set, including handling HR concerns, which allowed them to act with significant impunity, the filing explains.

This legal maneuver arrives almost a year after Lively initially filed her lawsuit in December 2024. If the court grants her motion and denies Baldonis dismissal request, the case is expected to proceed to trial, with a tentative start date set for March 2026.
