  3. Neighbor's dangerous actions leave homeowner distraught: 'I'm currently laying in bed shaking'

Fire hazards pose serious risks, not only for potential burns but also for the surrounding community due to smoke exposure. A Rochester, New York resident turned to Reddit seeking guidance about a neighbor who was illegally burning items on their front porch.

"My neighbor in the 19th ward burns items in a metal trash can on their porch, and the smoke fills my entire home," the poster explained.

"I'm currently lying in bed shaking because the smoke startled me awake. Is this legal in Rochester can someone burn items so close to other homes?"

The concern was not unfounded. The poster shared a personal history that made smoke especially alarming: "I have trauma from a previous apartment fire, so I'm very sensitive to the smell of smoke."

Comments from Reddit users echoed the danger. One wrote, "This is clearly a fire risk," while another advised, "Call the fire department immediately."

This incident highlights the severe risks of illegal burning. Even a wooden porch could ignite, potentially spreading fire to neighboring properties. Beyond physical danger, the activity shows a disregard for nearby residents and local air quality.

New York State law strictly forbids burning trash under any conditions. The state website states: "Burning refuse, trash, tires, and other solid wastes. This includes burning trash or other solid wastes in a burn barrel or similar device."

Engaging in such activity threatens health, property, and community well-being. Rochester residents also have access to regular trash and recycling collection, making open burning unnecessary. Burning materials like plastic can emit harmful chemicals into the air.

As one commenter summarized, "No open burning in NYS that's the law. Contact the fire department if it happens again."

Author's Analysis: Illegal Burning Poses Clear Community Risks

The recent Reddit post from a Rochester resident underscores a broader public safety issue. The neighbor's practice of burning items on a front porch is not only illegal under New York State law but also creates immediate fire hazards. The smoke infiltrating nearby homes presents both health and safety risks, particularly for residents with prior trauma or respiratory sensitivities.

New York law explicitly prohibits burning trash, tires, and other solid wastes, including in barrels or metal containers. Despite this clear legal framework, the reported behavior demonstrates a disregard for both safety and community standards. The potential for a porch fire to spread to neighboring properties is high, making the situation a serious concern for local authorities.

Residents have safe alternatives for waste disposal through regular trash and recycling collection. Open burning of plastics or other materials further exacerbates the risk by releasing toxic chemicals into the air. Immediate action, such as notifying the fire department, is strongly advised to prevent harm to people and property.
