Local councillors have rescinded approval for the demolition of a Dorset hotel after the developer failed to meet key planning obligations. In 2023, MHA Burleigh Poole had received the green light to tear down the Poole Quay Hotel and build a new development including commercial spaces, apartments, and a replacement hotel, contingent on a Section 106 agreement to fund local services.
However, in March 2024, the hotel unexpectedly closed, and the company entered liquidation. At a recent planning committee meeting of Bournemouth, Christchurch and Poole (BCP) Council, councillors voted to revoke the redevelopment permission because the developer missed the deadline to sign the Section 106 agreement.
The initial approval required a contribution of 655,948 from the developer to support local education, transport, and public open spaces. Following the companys liquidation, MHA Burleigh Poole came under new ownership in January 2024. A Section 106 agreement was sent in April with a 14-day signing window, which was later extended from 31 October to 20 November at the companys request.
During Thursdays meeting, councillors were informed that the agreement still remained unsigned, prompting the committee to formally overturn the previously granted permission.

Looking forward, any future redevelopment proposals for the site will need to meet the council’s strict conditions from the outset. This case serves as a clear signal to other developers about the non-negotiable nature of Section 106 agreements and the potential consequences of failing to comply.
