A court ruling has upheld the decision to reinstate James Gilbert, a transplant surgeon previously suspended for sexual harassment. The Court of Appeal dismissed the challenge against his return to practice, allowing him to resume his medical career despite earlier allegations of misconduct.

Court affirms decision to reinstate surgeon accused of harassing staff

An attempt to prevent a transplant surgeon who sexually harassed four female colleagues from resuming his medical practice has been unsuccessful. The Court of Appeal dismissed the challenge against his reinstatement, allowing him to return to work.

Background of the Case

James Gilbert held positions at Oxford University Hospitals (OUH) NHS Trust, initially as a senior registrar from 2008 to 2009 and later as a consultant from 2010 to 2022. In 2024, he was suspended from practicing medicine for 12 months due to findings of sexual harassment. The Medical Practitioners Tribunal Service (MPTS) later restored Gilbert's right to practice, concluding that he had taken sufficient steps to prevent a recurrence of his misconduct. Following this, the General Medical Council (GMC) filed an appeal, arguing that Gilbert should be permanently removed from the medical register. The Court of Appeal has now dismissed this appeal.

Statements from the Authorities

A GMC spokesperson emphasized the organization's position on sexual misconduct in healthcare:

"There is no place for sexual misconduct in healthcare, and we have always maintained Dr. Gilbert should have been struck off. We appealed twice in this case to secure an outcome that we felt would protect patients and uphold confidence in the profession."

The MPTS previously determined that Gilbert's fitness to practice was no longer impaired, enabling him to return to work on 12 September.

Details of Misconduct

Gilbert's misconduct involved inappropriate sexual comments towards trainees and colleagues. Specific examples include:

  • Asking a trainee about her underwear and making intrusive comments about her appearance.
  • Staring at another trainee and commenting on her physical attributes, claiming to have been watching her.

Additionally, during a previous High Court case, Mr. Justice Calver found that Gilbert had made racist remarks towards colleagues. One colleague described him as the "golden boy" of his department and the central figure in Oxford's transplant program.

Professional History and Training

Gilbert trained at the University of Southampton and has a long-standing career in surgery. Despite prior exclusions and restrictions, he was allowed to return to work after a temporary suspension in May 2021, following concerns raised at OUH. Surgical trainees were later invited to report any issues, which contributed to his final dismissal in May 2022.

Gilbert's Response

In previous hearings, Gilbert stated that he now aims to be an ambassador for change in challenging power imbalances between senior and junior colleagues.
