The Department of Justice is reviewing whether several FBI interview summaries mentioning former President Donald Trump were wrongly excluded from public release under the Epstein Files Transparency Act, amid scrutiny over transparency and document completeness in the Epstein investigation.
The United States Department of Justice has announced it is investigating whether certain FBI interview summaries mentioning former President Donald Trump were mistakenly left out of the documents released under the Epstein Files Transparency Act. The review follows reports that three FBI reports referenced in official indexes were not included in the public release of materials related to Jeffrey Epstein.
Background of the Excluded Interviews
The missing documents concern four FBI interviews conducted in 2019 with a woman who accused Jeffrey Epstein of sexual abuse and additionally claimed that Trump had assaulted her decades earlier. Of these four interviews, only one summary was publicly disclosed. President Trump has consistently denied any wrongdoing in connection with Epstein, and no public evidence has substantiated the woman's allegations against him.
FBI 302 Summaries Under Examination
The FBI summaries, commonly known as "302s," were first referenced in materials submitted during the criminal trial of Ghislaine Maxwell, who was convicted in 2021 for sex trafficking. While the Justice Department released one summary, three others listed in the official index were not included in the public files. Independent journalist Roger Sollenberger initially reported the discrepancy. A Justice Department spokesperson stated the agency is reviewing whether the documents were misclassified during the release process. The spokesperson added, "Should any document be found to have been improperly tagged in the review process and is responsive to the Act, the Department will of course publish it, consistent with the law." Deputy Attorney General Todd Blanche has maintained that the department fully complied with the law and did not withhold any documents to protect Trump or other public figures.
Political Reactions
Senate Minority Leader Chuck Schumer sharply criticized the Justice Department's claims of compliance. Speaking in Washington, Schumer stated, "Donald Trump said he wants to turn the page on the Epstein files. Democrats are not going to let Donald Trump turn the page. The law requires the DOJ to release all the files—not just some of the files. Not just the ones they pick and choose." Schumer accused Attorney General Pam Bondi and other department officials of concealing information, adding, "Let me be blunt. There is a massive cover-up going on in the Justice Department to protect Donald Trump and people associated with Jeffrey Epstein. They release some documents that they want to release and continue to hide others." He also indicated that Senate Democrats plan to review unredacted files in the coming days and ensure internal records related to the review process are preserved, stating, "We're going to pull on every thread. We're going to chase every lead. The truth will come out."
Scope and Legal Requirements for Document Release
The Epstein Files Transparency Act, enacted by Congress in November, requires the Justice Department to release the majority of investigative materials connected to Epstein and Maxwell. Exceptions include information protected by legal privilege, ongoing investigations, duplicate files, and data that could identify victims. The department initially released a batch of documents in December, followed by millions of pages in January. Hundreds of attorneys reviewed the files and redacted any identifying information of alleged victims. Officials have acknowledged that some documents may have been miscategorized and have set procedures to correct any mistakes. The current review specifically focuses on whether the three missing FBI interview summaries should have been disclosed under the law.
Related Developments
Some of the released files indicate the FBI found no evidence that Epstein operated a sex trafficking network. Lawmakers have expressed concern that the Justice Department may be protecting powerful individuals referenced in the Epstein materials. Alleged victims have also called for the removal of the Epstein files website. This DOJ review represents the latest effort to ensure transparency in the release of Epstein-related investigative documents and responds to increasing political scrutiny over the completeness of the public record.
