The Court Administration has presented a detailed briefing to lawmakers, warning that prosecuting those responsible for the October 7 massacre will demand extensive legal reforms, significant funding, and thorough preparation, regardless of whether a civilian court, military tribunal, or a specialized court is chosen.
In its most comprehensive analysis yet, submitted to the Knesset Constitution, Law and Justice Committee, the Administration outlined the legal and operational hurdles Israel faces in moving forward with prosecutions. The memorandum has become central to ongoing legislative discussions, including a bill proposing a dedicated tribunal for genocide and mass atrocity crimes related to the attack.
Unprecedented Scope of October 7 Cases
The document emphasizes that the scale and nature of the October 7 attacks carry significant structural, procedural, and security-related implications that must be addressed before indictments can proceed. It stresses that, despite the national trauma, Israels judicial system must uphold democratic principles such as fair trials, transparent procedures, proper evidence handling, and the right to appeal.
If civilian courts are used, the Beersheba District Court is identified as the most suitable venue due to its proximity to the attack sites and its potential to manage large, complex proceedings. However, substantial reinforcements, infrastructure expansion, and dedicated judicial appointments would be required before trials could commence.
Logistical and Structural Requirements
The briefing outlines extensive demands for court operations, including the number of special judicial panels needed, depending on whether cases are consolidated or split. A large consolidated indictment could require synchronized courtrooms, extended shifts, and judges trained for large-scale atrocity trials. Courts would also need secure facilities for high-risk defendants, protected witness areas, and space for extensive public and international scrutiny.
Security and detainee transport are highlighted as critical factors. Currently handled by the Israel Prison Service for military trials, any shift in responsibility to military police or a hybrid system would require new training programs, resources, and could disrupt existing operations.
Necessary Legal Changes
The memorandum details required statutory amendments, including changes to judicial appointment procedures for special panels and updates to evidentiary and procedural law. Without these, core elements of the trials could be legally challenged.
Indictment Structuring Options
The Administration, alongside the prosecution, proposed three models for handling indictments: a single comprehensive indictment, a hybrid model starting unified and later split by operational zones, or multiple individual indictments per community or site attacked. Early centralization is favored to conserve resources and create a coherent record, though cases involving attackers across multiple locations will require careful legal design.
The document warns that even after lawmakers select a framework, weeks or months of preparation will be needed to ready the judicial system. Some military courts, such as Lod, have not functioned for years and would require complete rebuilding of infrastructure, staffing, and procedures. Rapid initiation of trials under current systems is considered unrealistic.
