House committee issues subpoena for Trump prosecutor Jack Smith to testify

On December 3, the Republican-led House Judiciary Committee issued a subpoena to Jack Smith, the former special counsel who oversaw prosecutions against former President Donald Trump. The subpoena, shared on social media, requests Smith to provide testimony during a deposition scheduled for December 17 and to supply related documents as part of the committees review of the Trump-related cases.
Chairman Jim Jordan, R-Ohio, stated that the subpoena is part of the committees effort to examine the legal proceedings Smith conducted while Trump was out of office. A deposition is a formal procedure in which testimony is given under oath, typically in a private setting.
Smiths attorney, Peter Koski, noted that Smith had previously offered to answer questions voluntarily in a public hearing, weeks before the subpoena was issued. Koski said, We are disappointed that the voluntary offer was declined, preventing the public from hearing directly from Jack about these matters. He looks forward to meeting with the committee later this month to clarify his work and address misunderstandings regarding the investigations.
Smith led prosecutions against Trump in two separate cases. One case involved allegations of mishandling classified documents, while the other concerned efforts to overturn the results of the 2020 presidential election. Trump pleaded not guilty in both cases. Smith later dropped the prosecutions following Trumps 2024 election victory, citing Justice Department policy against charging sitting presidents.
The subpoena coincides with ongoing Justice Department efforts under Trumps administration to investigate figures who previously investigated or criticized him. In September, Trump suggested on social media that former FBI Director James Comey and New York Attorney General Letitia James should face criminal charges. Following this, grand juries indicted both individuals, though the indictments were later dismissed by a judge in November because the prosecutor responsible for the charges, a former Trump attorney, was not properly appointed.
Comey led the FBI during the early period of Trumps first term, overseeing investigations into potential contacts between the 2016 Trump campaign and Russia. After being dismissed by Trump, Comey became a vocal critic of the former president.
New York Attorney General Letitia James filed a civil suit against Trump in 2022, alleging years of inflated asset valuations to secure better loan terms. A judge ruled in her favor and imposed a financial penalty of roughly $500 million, including interest. While an appeals court upheld the finding of fraud, it removed the financial penalty as excessive. James office has appealed that decision.
