Kenyan court rules seed sharing ban unconstitutional

KISUMU, Kenya On Thursday, a Kenyan high court ruled that certain provisions of the countrys seed legislation were unconstitutional, marking a significant victory for food security advocates. The contested law had prohibited farmers from distributing and selling traditional seeds.
Under the 2012 seed law, farmers risked up to two years in prison and fines of 1 million Kenyan shillings ($7,700) for sharing seeds through community seed banks. Justice Rhoda Rutto declared that the sections of the law granting government officials authority to confiscate seeds and raid community seed banks violated constitutional rights.
The legislation was originally enacted to limit the sale of counterfeit seeds that were causing losses in agriculture and to grant exclusive trading rights to licensed seed companies. Fifteen smallholder farmers, all members of longstanding community seed banks, challenged the law to protect their right to save and share seeds.
Samuel Wathome, one of the plaintiffs, said the ruling restored traditional farming practices. My grandmother saved seeds, and now the court has confirmed that I can continue this for future generations without fear of imprisonment, he explained.
Elizabeth Atieno, a food activist with Greenpeace Africa, praised the decision as a win for culture and sustainability. Recognizing indigenous seeds undermines the corporate control of our food system. In Kenya, communities can now legally use climate-resilient, locally adapted seeds, she said.
Food advocates have long urged governments to collaborate with farmers to preserve indigenous seeds, which are often drought-resistant and better suited to local climates than hybrid varieties. Kenya maintains a national seed bank near Nairobi, but farmers emphasize the importance of community seed banks for diversity and accessibility.
The ruling comes amid ongoing challenges in the seed sector, where counterfeit seeds have caused significant financial losses in a country heavily dependent on rain-fed agriculture.
