Missouri court mandates revised language for ballot initiative aiming to limit abortion access

JEFFERSON CITY, Mo. On Thursday, a Missouri appeals court panel mandated new language for a ballot initiative aimed at limiting abortion rights in the state. The court ruled that voters must be clearly informed that the amendment would revoke reproductive healthcare rights approved just last year.
This decision adds another chapter to Missouri's ongoing struggle over abortion laws, which have shifted between restrictive and permissive since the U.S. Supreme Court overturned Roe v. Wade in 2022, ending the nationwide right to abortion. Following the Supreme Court ruling, a Missouri law banning most abortions went into effect. Subsequently, abortion-rights supporters collected signatures to place a 2024 ballot amendment allowing most abortions, which narrowly passed.
In response, the Republican-led state Legislature introduced a new ballot measure for 2026 that would repeal the previous amendment and limit abortions to cases of medical emergencies, fetal anomalies, or rape or incest up to 12 weeks of pregnancy. The proposal would also ban gender transition treatments for minors, which are already prohibited under state law.
A state judge in September invalidated the initial ballot summary drafted by Republican lawmakers, calling it insufficient and misleading. A revised summary, prepared by Republican Secretary of State Denny Hoskins, was later approved by the judge. However, the appeals court ruled Thursday that Hoskins version falsely implies that the measure would guarantee new access to reproductive healthcare.
The court ordered updated ballot language specifying that the measure would Repeal the 2024 voter-approved Amendment providing reproductive healthcare rights, including abortion through fetal viability, while outlining the specific circumstances in which abortion would remain permitted.
Hoskins' office declined to comment on the ruling, and the attorney general's office, which defended the summary, did not immediately respond to inquiries.
The American Civil Liberties Union, which initiated the lawsuit, said the ruling underscores the importance of voter awareness. It is crucial that Missourians know they are being asked to end the protections for reproductive health care that we just passed in the last general election, stated Tori Schafer, director of policy and campaigns at the ACLU of Missouri.
In the November 2024 elections, abortion-rights advocates succeeded on seven ballot measures nationwide while losing on three. Similar abortion-related amendments are expected on the ballot next year in Nevada, and potentially in Virginia as well.
