On December 23, the Department of Veterans Affairs (VA) implemented a policy that imposes a near-total ban on abortion services for veterans and their families, including in cases of rape or incest. This decision is the latest in a series of regulatory changes affecting reproductive rights within federal agencies.
Key Details of the New Policy
The ban is grounded in an internal memorandum issued by the VA, which aligns with legal guidance provided by the Department of Justice (DOJ) on December 18. According to the DOJ's legal opinion, federal law does not authorize the VA to broadly offer abortion services. This new directive overturns the policy implemented under the Biden administration in 2022, which had allowed veterans and their dependents access to abortion services after the Supreme Court's decision to overturn Roe v. Wade.
The move also accelerates the implementation of a rule proposed by the Trump administration in August, which aimed to revoke most abortion access at VA facilities. As a result, abortion services will now be significantly restricted within the VA system.
Reactions to the Policy Change
The new policy has faced considerable backlash from House Democrats, who have described it as "cruel and dangerous," with some accusing the administration of enacting the policy "under the cover of the holiday season." Mark Takano, a California Democrat and ranking member of the House Veterans Affairs Committee, condemned the decision in a statement, arguing that it undermines the healthcare autonomy of veterans.
Takano criticized the VA for prioritizing political views over the health needs of veterans, stating: "Instead of trusting veterans to make the healthcare decisions that are best for them, VA is allowing political opinion to supplant its duty to veterans. Instead of allowing veterans to discuss all their healthcare options openly and honestly with their providers, VA has decided that the government should be in charge of making healthcare decisions, even in matters of life and death."
Department of Veterans Affairs' Justification
In response to the criticism, VA Press Secretary Peter Kasperowicz defended the new policy, stating that the department's actions were in compliance with the DOJs legal opinion. Kasperowicz emphasized that the DOJ's stance aligned with the VA's proposed rule, which is still undergoing the regulatory process. He added that the legal shift effectively reverses the guidance issued under the Biden administration, which had argued that the VA could fund abortions for any reason and at any stage of pregnancy.
