In a forceful post on social media, former President Donald Trump announced his intention to nullify every document signed by President Joe Biden using an autopen. Trump also stated that if Biden falsely claimed involvement in the autopen process, he would face perjury charges. This latest statement is part of Trumps ongoing pattern of targeting political rivals using federal authority.
Any document signed by Joe Biden via the Autopen, roughly 92% of them, is now considered invalid and without legal effect, Trump posted on Truth Social. The Autopen cannot be used without explicit presidential approval.
Trump added, I am cancelling all Executive Orders and any other documents not personally signed by Joe Biden, because those operating the Autopen did so unlawfully. If Biden claims he participated in the process, he will be charged with perjury.
Republicans have increasingly focused on Bidens use of the autopen, suggesting that staff signed official documents on his behalf due to perceived age-related cognitive decline. House Oversight Committee Chairman James Comer (R-Ky.) asserted, without presenting evidence, that Biden may not have been fully aware of the pardons he approved.
As a symbolic gesture, Trumps administration has displayed a portrait of an autopen instead of Bidens image in its White House Wall of Fame. Trump described Bidens presidency as effectively taken over by Radical Left Lunatics, making his autopen-signed documents void.
The method by which the Trump administration would identify autopen-signed documents remains unclear, raising questions about potential impacts on legislation, pardons, and executive orders. The approach also invites scrutiny over documents Trump himself may have signed using an autopen. At 79, Trump has denied any health concerns.
Bidens former aides maintain that no significant decisions were made by staff in his stead.
Trumps announcement coincides with a series of controversial posts during Thanksgiving, including derogatory remarks about Minnesota Governor Tim Walz and comments on mortgage policies, as well as reactions to a fatal shooting near the White House involving National Guard members.
Additionally, Trump criticized Democratic lawmakers who shared a video urging military personnel to refuse illegal orders, labeling it SEDITIOUS BEHAVIOR FROM TRAITORS and claiming it could be punishable by death. The Pentagon reportedly threatened court-martial action against Senator Mark Kelly (D-Ariz.), a Navy veteran featured in the video.
Despite aggressive rhetoric, Trumps attempts to pursue legal action against political opponents have faced setbacks. Recently, a federal judge dismissed notable cases against New York Attorney General Letitia James and former FBI Director James Comey.
Author’s Analysis: Implications of Trump’s Autopen Claims
Former President Donald Trump’s declaration to nullify all documents signed by President Biden via autopen represents a continuation of his strategy to challenge political opponents through federal authority. While the statements are forceful, the legal mechanism for such nullification remains undefined, raising serious questions about enforceability and potential conflicts with established law.
Trump’s claims hinge on the assertion that roughly 92% of Biden’s autopen-signed documents are invalid, yet there is no evidence suggesting unlawful intent or procedural violation by the Biden administration. Former aides of President Biden maintain that staff did not make substantive decisions in his stead, indicating that the autopen’s use aligns with standard administrative practice.
Republican criticisms regarding autopen use appear largely symbolic, reinforced by the display of a portrait of the device on Trump’s “Wall of Fame.” Practical implementation of Trump’s proposed actions could affect executive orders, pardons, and legislation, but the approach lacks clarity and may expose Trump himself to scrutiny regarding his own autopen use.
Overall, the announcement underscores political polarization and illustrates how symbolic actions can dominate public discourse. While legally uncertain, the rhetoric serves to energize a political base and maintain media attention, rather than produce concrete administrative change.
