The lawsuit, filed by Jordans 23XI Racing alongside Front Row Motorsports, brings antitrust allegations against the top racing series, exposing tense communications, financial details, and long-standing animosities among NASCAR executives and team owners.

NASCAR Commissioner Steve Phelps confirmed the organization sought to settle the case before the trial began. The lawsuit was initiated by 23XI Racing, co-owned by Jordan, Hamlin, and Jordans business manager Curtis Polk. Front Row Motorsports, owned by Bob Jenkins, joined the suit. Both teams refused to sign new charter agreements offered by NASCAR in late 2024, citing unmet demands for permanent charters, larger revenue shares, and governance participation.
The teams contend NASCAR exercises monopoly-like control over the sport through exclusive clauses, ownership of tracks, and rulemaking authority. They are seeking significant financial compensation for legal fees and losses incurred this year from operating without charters. NASCAR, founded 76 years ago by the France family, maintains it has not violated antitrust law, noting increased payouts and the option for teams to compete as open teams in non-chartered spots.
During pretrial discovery, sensitive communications surfaced, including derogatory remarks from NASCAR executives toward other team owners and drivers. Similarly, 23XI leadership admitted to contentious statements regarding the France family and business operations. These revelations have amplified the tension surrounding the trial.
NASCARs defense includes declarations from non-suing teams, showing support for the charter system while acknowledging that 2025 agreements still fall short of all requests. Key team owners Rick Hendrick and Roger Penske have sought to limit their testimony. Jordan and Jenkins will act as the public faces of the lawsuit, while rulings on courtroom access for other 23XI representatives remain pending.
The trials outcome could dramatically alter NASCARs structure. If 23XI and Front Row succeed, remedies could include financial damages, restructuring of the charter system, or even the sale of the sport by the France family. Conversely, a NASCAR victory may result in the sale of the six charters held by the plaintiffs, potentially ending their operations beyond 2026.
The case remains open to settlement at any stage, with appeals possible even after a verdict. The jurys decision will determine damages, and the presiding judge could adjust or triple awarded sums, reshaping the future of NASCAR racing.
