ICE Detains Father and 6-Year-Old Son During Routine Check-in, Leading to Separation

On November 26, a routine check-in at the New York City office of Immigration and Customs Enforcement (ICE) led to the separation and detention of a father and his young son. Fei Zheng and his 6-year-old child, Yuanxin, who had sought asylum after leaving China, were attending a scheduled appointment at ICE headquarters at 26 Federal Plaza when authorities separated them.
Fei Zheng was taken to an adult detention facility in Orange County, New York. Meanwhile, the location of his son, a first-grade student, has not been disclosed. Advocates accompanying the family reported that Zheng complied with the check-in requirements but was still arrested.
According to federal records, Zheng displayed aggressive behavior during his arrest, expressing suicidal thoughts, which resulted in him being handcuffed and transported to the detention center. ICE officials then arranged for the boy to be placed with the Office of Refugee Resettlement, responsible for unaccompanied immigrant children.
The father and son had previously entered the U.S. illegally via the southern border in April, where they were apprehended in California. Attempts by ICE to deport Fei Zheng back to China in September and October were unsuccessful, as he refused due to fear of the Chinese government. Afterward, the family settled in Queens, New York, and the boy was enrolled in school.
Federal records indicate that both Fei and Yuanxin are expected to be reunited later this month for deportation back to China. Fei Zheng's attorney described the case as deeply troubling, highlighting the uncertainty surrounding the situation.
Department of Homeland Security Assistant Secretary Tricia McLaughlin stated that ICE does not intentionally separate families, asserting that children are either deported with their parents or placed with a safe guardian if parents refuse. She noted that Zheng had opportunities to leave the country with his son but chose not to comply with a deportation order, which she emphasized is a legal requirement.
The case has prompted criticism from politicians. New York City mayor-elect Zohran Mamdani condemned the separation, while Senator Chuck Schumer and Representative Nydia M. Velzquez are seeking information regarding the childs whereabouts. City Council Member Julie Won confirmed that the boy is currently safe and stressed the importance of protecting families in New York City.
Author's Commentary: ICE Family Separation Raises Legal and Human Concerns
The recent detention of Fei Zheng and his 6-year-old son at ICE headquarters in New York highlights ongoing tensions in U.S. immigration enforcement. Despite attending a routine check-in and complying with requirements, Zheng was separated from his child and placed in an adult detention facility. The location of his son, temporarily under the Office of Refugee Resettlement, underscores the complexity of family separation procedures.
Federal officials emphasize that ICE does not deliberately separate families and that Zheng had opportunities to leave with his son. However, the case illustrates the challenges asylum seekers face when fleeing countries with credible fear of persecution. The legal framework requiring compliance with deportation orders can conflict with humanitarian considerations, creating situations where families are involuntarily divided.
Politicians and advocates have voiced concern over the case, calling for clarity and protections for children. While ICE asserts that the boy is under safe care, the broader implications for asylum seekers and family rights in the United States remain unresolved. This incident serves as a reminder of the need for transparent policies that balance legal obligations with human rights protections.
