On Wednesday, an organization opposing diversity, equity, and inclusion (DEI) initiatives filed a lawsuit against the Hispanic Scholarship Fund (HSF), claiming it unjustly restricts scholarships to Hispanic students only. The American Alliance for Equal Rights asserts that this practice violates the Civil Rights Act of 1866 by denying benefits to non-Hispanic applicants.

The lawsuit notes that HSF has distributed over $750 million in scholarships to more than 65,000 students. Recipients gain access to various benefits, including substantial scholarship funding, specialized mentorship programs, private seminars, and additional exclusive opportunities.

The American Alliance for Equal Rights maintains that two of its members are negatively affected by HSF's ethnicity-based eligibility requirements. HSF is deliberately discriminating based on ethnic background, the groups legal team stated, referencing a precedent from a case against Oberlin College that identified overtly discriminatory policies as evidence of intentional bias.

According to the lawsuit, the scholarship program explicitly excludes non-Hispanic applicants. The complaint also cites statements from HSF decision-makers, including social media posts and website content, suggesting an intentional preference for Hispanic participants.

This legal action emerges amid a broader scrutiny of DEI programs initiated during the Trump administration, which has been both endorsed and criticized by various political groups. Yale law professor Justin Driver, author of The Fall of Affirmative Action, described the case as part of a larger movement challenging race-conscious policies. He noted that the notion of Latinos receiving excessive scholarship support is considered a minor concern relative to other national issues.

The American Alliance for Equal Rights is seeking a temporary restraining order and a preliminary injunction to prevent HSF from closing the current scholarship application period or awarding scholarships until the court reviews the case. Additional legal remedies are also being pursued.
