The widow of Dana Diamond, a UPS pilot who tragically lost his life in a fatal plane crash in Louisville in November 2025, has filed a wrongful death lawsuit against three major corporations. The companies are accused of contributing to the series of events that led to the disaster. Donna Diamond, the 62-year-old pilot’s wife, named Boeing Co., General Electric Co., and VT San Antonio Aerospace in her lawsuit, which was submitted on February 25, 2026, in Jefferson County Circuit Court.
Details of the Crash
The crash occurred on November 4, 2025, and stands as the deadliest incident in the history of UPS Airlines. The UPS MD-11 cargo plane, which was en route from Louisville, Kentucky, to Honolulu, Hawaii, erupted into a fireball shortly after takeoff. All three crew members onboard, including Dana Diamond, were killed, as well as 12 individuals on the ground, ranging from ages 3 to 62. In total, 15 lives were lost in the catastrophic event.
According to federal investigators, the crash was caused by a mechanical failure. Just seconds after takeoff, the left engine and its pylon detached from the plane’s wing, which resulted in an engine fire and ultimately caused the crash. The National Transportation Safety Board (NTSB) later determined that the hardware used to secure the engine showed signs of fatigue and an “overstress failure,” which contributed significantly to the disaster.
Accusations in the Lawsuit
In her lawsuit, Donna Diamond claims that the three companies involved played a direct role in the mechanical failure that led to the crash. The complaint alleges that VT San Antonio Aerospace, which performed maintenance on the aircraft just weeks before the incident, and General Electric, which designed and manufactured the plane's engines, were responsible for the failure. Additionally, Boeing, the successor of McDonnell Douglas (the company that originally designed and manufactured the UPS MD-11F aircraft), is named as a defendant in the suit.
Legal Claims
The lawsuit raises several legal claims against the defendants:
- Wrongful Death: Donna Diamond seeks compensation for the loss of her husband.
- Negligence: The suit alleges that the companies failed to fulfill their responsibility in ensuring the safety of the aircraft.
- Loss of Consortium: The lawsuit claims that the tragic death of Dana Diamond has caused significant emotional distress to his wife, Donna Diamond.
- Strict Product Liability: The lawsuit holds General Electric and Boeing accountable for injuries caused by defective products, particularly the engines and other critical components of the plane.
In addition to seeking damages, Donna Diamond has requested a jury trial and is pursuing punitive damages, which are meant to penalize the companies for their alleged negligence and misconduct.
Reactions from the Companies Involved
In response to the lawsuit, the companies involved have issued public statements expressing their condolences while also emphasizing their commitment to safety:
- Boeing: A representative from Boeing extended condolences to the victims' families, stating, “We extend our deepest condolences to the families and friends of those who lost their lives in this accident.” The company also assured that it is cooperating fully with the ongoing investigation.
- General Electric (GE) Aerospace: GE Aerospace shared their sadness, stating, “We are deeply saddened by the loss of UPS Flight 2976 and extend our heartfelt sympathies to the families and loved ones impacted. Safety is our first priority, and we are supporting the NTSB's investigation.”
- VT San Antonio Aerospace: Attempts to reach VT San Antonio Aerospace for comment on the lawsuit were unsuccessful, as no immediate response was received.
Additional Lawsuits Filed
While Donna Diamond’s lawsuit is the first filed by a family member of the flight crew, it is not the first legal action stemming from the crash. In December 2025, the families of two victims on the ground at the time of the crash filed wrongful death lawsuits. In January 2026, another lawsuit was filed against General Electric, VT San Antonio Aerospace, Boeing, and UPS, drawing further attention to the companies' potential liability in the incident.
As the legal proceedings unfold, the families of the victims hope to hold the responsible parties accountable for their roles in the deadly disaster. Investigations by both the NTSB and the ongoing lawsuits will continue to probe the causes of the crash, with the aim of preventing similar tragedies in the future.
