A new legislative initiative introduced by Rep. Eric Sorensen, D-Ill., proposes the establishment of an independent federal board tasked with investigating severe weather disasters, similar to the National Transportation Safety Board (NTSB), which currently handles major transportation incidents including aviation and train accidents. At present, there is no standardized federal mechanism for systematically reviewing extreme weather events such as floods, hurricanes, or other natural disasters to prevent recurring fatalities and damage.

The National Weather Safety Board Act

The proposed measure, named the National Weather Safety Board Act, outlines the creation of a board consisting of a minimum of seven members, appointed by the president and confirmed by the Senate. Members would be selected based on expertise in meteorology, emergency management, social sciences, and other relevant disciplines. The board would operate in a manner comparable to the NTSB, conducting formal investigations and issuing reports on major incidents.

Responsibilities and Powers

  • Investigate severe weather events classified as major disasters by the president under the Stafford Act.
  • Examine incidents resulting in at least 10 fatalities, 100 injuries, or rapid-onset mass casualty situations.
  • Decide by majority vote within 14 days of a qualifying disaster whether a formal investigation will proceed.
  • Access data from federal agencies including the Army Corps of Engineers, Department of Homeland Security, FEMA, Federal Communications Commission, and NOAA.
  • Produce a preliminary report within 90 days and a comprehensive final report within 20 months following a disaster.
  • Use subpoena power to obtain testimony, documents, and other evidence necessary for the investigation.
  • Provide recommendations and findings to agencies such as the National Weather Service, FEMA, and the Army Corps of Engineers.

Background and Motivation

The concept of a federal weather disaster review board has been under discussion among meteorologists and emergency management professionals for many years. Interest in formal legislation increased following the Texas floods in July, which caused over 130 deaths, including 27 campers and counselors at a camp along the Guadalupe River. The event prompted examination of forecasting practices, emergency response systems, warning mechanisms including cellphone alerts and sirens, and federal flood map accuracy. Sorensen, who is the only meteorologist serving in Congress, emphasized that the board would operate independently and nonpartisanly, providing Congress with accurate data and findings to help reduce future casualties from severe weather events.

Support and Bipartisan Considerations

The idea has attracted attention from legislators across party lines. Senators Brian Schatz, D-Hawaii, and Bill Cassidy, R-La., along with former Rep. Katie Porter, D-Calif., have shown interest, and similar proposals have been introduced by some Republican lawmakers, including Rep. Nancy Mace, R-S.C.. Currently, the bill lacks a Republican co-sponsor. Neil Jacobs, former NOAA administrator under President Trump, has publicly supported the concept, citing the importance of gathering data on warnings issued, their effectiveness, and failures in major weather events. Additionally, Douglas Hilderbrand, executive director of the American Weather Enterprise Association, is collaborating with Sorensen on the proposal, highlighting the bipartisan nature of weather-related issues and expressing optimism about the bill’s chances of passing.

Implementation and Next Steps

Once established, the board would have the authority to promptly investigate disasters, produce preliminary and final reports with actionable recommendations, and work collaboratively with federal entities such as NOAA, FEMA, and the Army Corps of Engineers to improve response and preparedness. The National Weather Safety Board Act aims to address a longstanding gap in federal oversight by creating a structured process for reviewing severe weather events, providing actionable insights to reduce human and material losses, and complementing existing systems that manage transportation accidents.
