DOJ expected to request new indictment for Letitia James: Report

According to MSNOW, federal prosecutors are preparing to pursue a new indictment against New York Attorney General Letitia James. The decision follows last weeks dismissal of previous criminal charges against James and former FBI Director James Comey by a federal judge.

Assistant U.S. Attorney Roger Keller, usually stationed in Missouri, is expected to present the renewed case to a grand jury in Norfolk, Virginia.

Initial Indictments Overturned, Path Open for Refiling

U.S. District Judge Cameron McGowan Currie ruled the original indictments invalid because Lindsey Halligan, acting U.S. attorney for the Eastern District of Virginia who filed the charges, lacked proper authority. The judge dismissed the cases without prejudice, allowing the Justice Department to pursue new charges.

The prosecutions of James and Comey have faced multiple challenges from the start. Career prosecutors in the Eastern District of Virginia previously determined there was insufficient evidence to support the charges. Political pressure from former President Donald Trump reportedly influenced the departments initial actions.

Next Steps and Legal Considerations

The Justice Department has yet to submit the appeal announced by the White House on November 24. Senior DOJ officials have been deliberating strategy and have concluded that re-indictments for both James and Comey are necessary.

MSNOW notes that Judge Curries ruling highlighted a potential statute-of-limitations issue, which could complicate efforts to re-indict Comey.
