Collins explained that a federal grand jury in Virginia was asked to re-indict James, but the panel refused. She noted that grand juries generally have a lower threshold for indictments than trials, making this outcome particularly rare.

This marks the second unsuccessful attempt by the Justice Department to prosecute James for alleged mortgage fraud. The first case was dismissed due to the improper appointment of Trumps chosen prosecutor, Lindsey Halligan, as the interim U.S. attorney for the case. A different prosecutor was assigned for this second attempt.

Trump has yet to publicly respond to this latest development, though he has previously expressed strong criticism of James, particularly after she won a case against him and his business for fraud.
