Shawn Durbin, 39, and Nancy Ann Durbin, 36, have been formally charged with murder following the death of 62-year-old Bobby Pennington. Authorities report that a witness observed the couple forcibly remove Pennington from in front of their apartment and toss him over the railing of a second-story balcony. The fall, landing on a concrete surface below, was approximately 11 feet 6 inches.

Initially arrested on first-degree assault, the Durbins charges were escalated to murder after Pennington succumbed to his injuries. Police were called to an apartment complex on East Memorial Drive in Elizabethtown on November 13 regarding an adult male in cardiac arrest. During the response, officers were informed that Pennington had been thrown from a second-story balcony.

Pennington was taken first to Baptist Health and later transferred to a university hospital, where he died four days later, on November 17. Both the victim and the couple lived in the same apartment complex. Police reported that a dispute occurred before the fatal incident, though the exact reason for the confrontation remains unknown.

Shawn Durbin faces additional charges, including two counts of third-degree assault and one count of resisting arrest, following an altercation with law enforcement during his apprehension. A grand jury indicted the Durbins on November 20, and their arraignment is scheduled for December 9. They remain in custody at the Hardin County Detention Center.
