US Supreme Court to Determine Legality of Trump's Birthright Citizenship Order

The United States Supreme Court has agreed to examine the legality of former President Donald Trumps directive aimed at significantly limiting birthright citizenship. The executive order, which sought to deny US citizenship to nearly all children born on American soil, was issued shortly after Trump began his second term and faced immediate legal challenges.

The order was a central part of Trumps immigration agenda and represented a dramatic reinterpretation of a 19th-century constitutional provision. Several judges across the country quickly blocked the policy through injunctions. In response, Trump appealed to the Supreme Court.

In a landmark ruling in June, the Supreme Court determined that nationwide injunctions issued by lower courts had overstepped their authority, but the justices did not resolve the underlying question of the orders constitutionality.

On Friday, the Supreme Court announced it would hear an appeal from the Justice Department challenging a lower court decision that had stopped the executive order. The order had instructed federal agencies not to recognize US citizenship for children born in the country if neither parent is a citizen or legal permanent resident.

The lower court had ruled that Trumps policy violated the 14th Amendment of the Constitution and federal law protecting birthright citizenship, following a class-action lawsuit filed by families affected by the directive. Historically, the 14th Amendment has been understood to guarantee citizenship to anyone born on US soil.
