Todd Tucker has filed for primary custody of his two children with Kandi Burruss and is challenging the validity of their prenuptial agreement as their divorce moves forward.

According to documents submitted on November 26, Tucker stated that their son Ace, 9, and daughter Blaze, 6, currently live with him in Georgia while Burruss fulfills work responsibilities outside the state. He noted that her professional commitments are expected to keep her away for several more months.

Tucker explained that he and Burruss have been attempting to resolve their issues cooperatively, and he affirmed that he intends to continue discussions in good faith. However, he indicated that if they fail to reach an agreement on custody, he will pursue primary physical custody, joint legal custody, and final decision making authority.

Despite the legal dispute, Tucker acknowledged Burruss as a devoted and capable parent and expressed hope that continued communication will help them settle all matters.

In the filing, Tucker also addressed their prenuptial agreement, signed before their April 2014 wedding. He claimed he was pressured to finalize the document without proper legal counsel, alleging that Burruss legal team presented him with the completed agreement immediately before the ceremony, without consulting his representatives who had been involved in earlier negotiations. Tuckers attorneys argued that these circumstances cast doubt on the agreements enforceability.

Additionally, Tucker is seeking a full division of marital assets, including both real and personal property, as well as tangible and intangible holdings. Should the prenup be deemed invalid, he may also request alimony alongside primary custody.

Last month, Burruss publicly confirmed that she and Tucker were ending their marriage after eleven years. She later shared that the separation had been developing for some time. Despite the split, the pair have maintained a cooperative relationship, recently coming together to celebrate their daughter Blazes sixth birthday and Thanksgiving.

Tucker is also father to Kaela Tucker, 29, from a previous relationship, while Burruss shares her daughter Riley, 23, with former partner Russell Spencer.
